Welcome to Campaign Direct. These Terms of Service ("Terms") govern your access to and use of the website at thecampaigndirect.com (the "Site") and any products, printing, or services (collectively, the "Services") offered by Campaign Direct LLC, a California limited liability company ("Campaign Direct," "we," "us," or "our"). By placing an order or using the Site, you agree to these Terms.

1. Who May Use the Services

The Services are intended for political campaigns, committees, organizations, and the consultants and vendors who serve them. By using the Services, you represent that you are at least 18 years old and have authority to enter into these Terms on behalf of yourself and any entity you represent.

We may decline, cancel, or refuse any order at our sole discretion, including for pricing or product-information errors, product unavailability, suspected fraud, or any other lawful reason, in addition to reasons relating to the political content, candidate, committee, cause, party, or viewpoint involved.

2. Products Are Custom-Made to Order

Nearly all products we sell are custom-printed to your specifications. Production does not begin until you have approved a proof (where applicable) and your order is paid in full. Because items are produced specifically for you, they are generally non-returnable and non-cancellable once production begins. See our Refund & Returns Policy for details.

3. Proofs and Approval

For many orders we will provide a digital proof for your review. For certain products, a printed (hard-copy) proof may be available for an additional charge and added turnaround time. It is your responsibility to carefully review every proof for accuracy — including spelling, names, dates, addresses, layout, colors, and required disclaimers — before approving it. Once you approve a proof, you accept the materials as shown and authorize us to produce them. We are not responsible for errors contained in an approved proof. Color shown on a screen is an approximation; printed color may vary (see the Refund & Returns Policy).

4. Your Content and Your Responsibilities

You are solely responsible for all text, images, logos, photographs, designs, and other materials you submit or approve ("Customer Content"). By submitting Customer Content, you represent and warrant that:

  • You own or have all necessary rights, licenses, and permissions to use and reproduce the Customer Content, including any photographs, artwork, fonts, trademarks, or third-party material.
  • The Customer Content is accurate and does not infringe any third party's intellectual property, privacy, or publicity rights, and is not defamatory or unlawful.
  • The Customer Content complies with all applicable federal, state, and local election and campaign-finance laws and regulations, including any required disclaimers, "paid for by" / authorization language, and disclosure statements (for example, under Federal Election Commission rules and applicable state and local requirements).

We do not review Customer Content for legal compliance, factual accuracy, or correctness, and we do not provide legal or campaign-finance advice. We print and produce exactly what you submit and approve; we do not verify the accuracy of any content, including names, dates, locations, factual claims, contact information, or other details, and you are solely responsible for that accuracy. We are not responsible for missing, incorrect, or non-compliant disclaimers or for the legality of any content you submit or approve. Compliance is your responsibility. You agree to indemnify and hold Campaign Direct harmless from any claims, damages, or costs arising out of your Customer Content or your use of the materials we produce.

5. Pricing, Payment, and Postage

Prices are listed in U.S. dollars and may change at any time before an order is placed. Payment is due at the time of order unless otherwise agreed in writing.

Pricing errors. Despite our best efforts, a product on the Site may occasionally be listed at an incorrect price, or with incorrect product information or availability, due to typographical error, system error, or information supplied by our vendors. We reserve the right to correct any such error and to refuse or cancel any order placed for a product listed at an incorrect price or with incorrect information, whether or not the order has been confirmed and your payment method charged. If your order is cancelled after your payment method has been charged, we will refund the amount charged. Nothing in this section obligates us to honor a price that we identify as erroneous.

For direct mail and any order including postage, we do not mark up postage. Postage and mail-preparation charges are quoted after your list is counted and are invoiced separately from your printing order; they are not part of checkout. Postage invoices may be paid by ACH, check, or credit card. The total differs by payment method: card payments include a processing charge, shown as a dollar amount on your invoice before you pay it. ACH and check payments do not include this charge. The charge is not applied where state law prohibits or limits it.

Campaign Direct is responsible for producing your mailing to the approved proof and tendering it to the United States Postal Service on the agreed drop date. Campaign Direct is not responsible for Postal Service handling, delivery timing, or non-delivery once mail has been accepted. In-home dates are estimates and are not guaranteed.

6. Production and Shipping Times

Production and shipping timeframes are estimates, not guarantees, and begin only after proof approval and full payment. We are not liable for delays caused by carriers, weather, supply issues, or events outside our reasonable control. See our Shipping Policy.

7. Intellectual Property

The Site and its content (excluding Customer Content) are owned by Campaign Direct or its licensors and are protected by law. You may not copy, reproduce, or use our branding or Site content without permission.

8. Design and Strategy Services

Any design, consulting, or direct-mail strategy guidance we provide is offered to help you produce effective materials. It is not legal, compliance, accounting, or campaign-finance advice. We do not guarantee any particular result, outcome, or level of performance — including electoral success, vote share, turnout, or response rates — and no such outcome is promised or implied. You remain responsible for the final content and legal compliance of everything you order.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Campaign Direct's total liability for any claim arising out of or relating to the Services will not exceed the amount you paid for the specific order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost votes, lost revenue, or missed mail dates.

11. Indemnification

You agree to defend, indemnify, and hold harmless Campaign Direct and its members, employees, and partners from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your Customer Content, your use of the Services, or your violation of these Terms or applicable law.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree that any dispute will be resolved in the state or federal courts located in the City and County of San Francisco, California, and you consent to the jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted to the Site. Your continued use of the Services means you accept the updated Terms.
